75 Private Security Agencies Lose Licence

PUNE: Over the last six months, police have cancelled licences of as many as 75 private security agencies in the city and issued show-cause notices to another 100 for serious lapses like not submitting required documents and hiring people with dubious background.
The Pune police had initiated the drive against errant private security agencies in December last year. As a part of the drive, the police officials scrutinised the documents of the agencies and their employees.

Joint police commissioner Sunil Ramanand told TOI, "It is time to act against errant security agencies since they are responsible for safeguarding the lives and properties of the citizens." The action was initiated under the provisions of the Private Security Agencies (Regulation) Act, 2005, he added.
At first, the licences of those agencies were cancelled which failed to submit legal documents such as Income Tax returns among others to the licence-issuing authority. "Most of these agencies had acquired the licences around five to six years ago. Despite having ample time at their disposal to submit the required documents, they chose to act otherwise," Ramanand said.

During the inspection process, police officials also came across some agencies which had hired guards without conducting proper background check. "In case of two agencies, they had recruited guards who were facing charges under serious offenses like rape. Also, some agencies had not completed the police verification of their staffers, which is mandatory," police said.

Also, in case of come agencies, they were not paying Provident Fund (PF) to their employees, which is against the rules laid down under the Private Security Agencies (Regulation) Act, 2005.
The police started giving licences to security agencies after the Act came into force in 2005. However, on January 3, 2013, the state police put a stay on issuing licences to private security agencies. However, the process was resumed in March 2-14 after many businessman approached the government against the police's move.

There are around 480 agencies in the city with each employing around 10 to 80 guards. So far, over 200 agencies have been scrutinized by the police and the rest will be covered in the coming days.


RECENT CASES

  • May 2016: City-based lawyer Vishnu Awati lodged a complaint with the Kothrud police stating that some persons allegedly beat him up on Karve Road for following irregularities in the licences awarded to private security agencies in the state.
  • March 2016: The Pimpri police arrested a security guard for allegedly stealing ornaments and cash, collectively worth Rs 80,000, from the famous Vaishno Devi temple in Pimpri Camp in February this year.
  • September 2015: The Airport police arrested a security guard of Lunkad Valencia building for his alleged role in the murder of senior citizen Satish Gopalrao Dravid who was alone in the flat when the incident occurred.
  • May 2015: The Chatushrungi police arrested three security guards for allegedly raping a 40-year-old woman in Baner, off Katraj - Dehu road bypass.

Obtaining PSARA 2005 License for Jai Ambe Private Security Agency

With concerns about crime and terrorism on the rise, the demand for private security services is rising steadily to protect against robberies, violence and other forms of crime. As both businesses and consumers are increasingly more aware of their need for security, knowing how to start a security company can be a viable business opportunity for entrepreneurs. However, starting a security company requires the correct training and licensing, as well as a sound understanding of business management and networking.

My main objective through this article is to address the legal aspect of this business which happens to be one of the most challenging obstacle to cross over.

The legal aspect of Private Security Agency Business is governed by “Private Security Agency Regulation Act, 2005” in short called as ‘PSARA’.

All the private Security agencies must obtain license under PSARA 2005 to operate in this business.

However first thing is first, the parties have to decide upon the model of their business organisation which depends upon various factors like Scale, finance, Liabilities, Control, etc.

Depending upon the suitability of the parties the model can be one of the following:

a)     Sole proprietorship

b)    Partnership Firm

c)     LLP

d)    Pvt. Ltd.  Or  Ltd. Company

e)     NGO


After the suitable model has been decided then parties can proceed with the obtaining the license under PSARA for which they need to refer PSARA 2005, with the rules laid by their respective state in the province of which business operation is to be conducted.


While filing the application for PSARA 2005, copies of registration certificate under various other Acts and Several other compliance documents is required to be annexed with the application form.
That means registration under PSARA calls for many other prior registrations and compliance.

Renew your licence

  • Request a new licence card to replace a lost, stolen or damaged licence
  • Change the name on your licence card due to a legal name change under the Change of Name Act or a change in marital status
  • Change your address or criminal record status
  • Change your licence category.

Processing time

Please apply to renew your licence at least 30 business days before your licence expires to ensure continuity of licensing.


Individual Responsibilities
